In Colorado, the legal framework for child custody is referred to as the “allocation of parental responsibilities,” encompassing both parenting time and decision-making authority. The state emphasizes the child’s best interests when determining these responsibilities, considering factors such as each parent’s ability to foster a positive relationship with the child, the child’s adjustment to home, school, and community, and the mental and physical health of all individuals involved.
Colorado law encourages both parents to actively participate in their children’s lives. The state uses the term “parental responsibility,” which can be either joint or primary. If parents equally share overnight visitation with the child, they have joint parental responsibility. If one parent has fewer than 90 overnight visitations per year, the other parent is considered to have primary parental responsibility.
Additionally, Colorado distinguishes between residential responsibility and decision-making responsibility. Sole decision-making responsibility allows one parent to make all major decisions regarding the child’s education, religion, extracurricular activities, and medical care without consulting the other parent. Joint decision-making responsibility requires both parents to share these decisions.
